These Terms of Use ("Terms") govern your use of the Swaddle mobile app (the "App") provided by Swaddle ("we," "us"). By downloading or using the App, you agree to these Terms. If you do not agree, please do not use the App.
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial use, subject to these Terms and the Apple App Store Terms of Service.
Swaddle offers supportive guidance based on sound analysis and general pediatric guidance. It does not diagnose, treat, or cure any condition and is not a substitute for professional medical care. Results are a best estimate, not a certainty. Always use your own judgment and consult a qualified healthcare provider for any concern about your baby's health.
You agree not to misuse the App, including by attempting to reverse engineer it, interfere with its operation, or use it in any unlawful way.
The App, its content, branding, and design are owned by Swaddle and protected by applicable laws. These Terms do not grant you any rights in our trademarks or content beyond the license above.
The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose. We do not warrant that the App will be accurate, uninterrupted, or error-free.
To the fullest extent permitted by law, Swaddle will not be liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the App. Nothing in these Terms limits liability that cannot be limited under applicable law.
We may update these Terms from time to time. Continued use of the App after changes take effect means you accept the updated Terms. We will revise the "Last updated" date above when we make changes.
These Terms are governed by the laws of the United States and the state in which Swaddle is established, without regard to conflict-of-law rules.
